1 Definitions

In these Terms:

"LivingLanka"

means the LivingLanka platform and its owners/operators.

"Platform"

means the LivingLanka website, mobile application and related services.

"User", "you" or "your"

means any person who accesses or uses the Platform.

"Seller"

means a person or business posting goods, property, vehicles, services or other listings.

"Buyer"

means a person interested in purchasing or obtaining goods or services.

"Listing" or "Advertisement"

means content posted by a User on the Platform.

"Transaction"

means any purchase, sale, rental, employment arrangement or other transaction between Users.

2 Acceptance of Terms

By registering for an account, posting an advertisement, contacting another User, browsing Listings or otherwise using LivingLanka, you agree to comply with these Terms.

If you do not agree with these Terms, you must not use the Platform.

LivingLanka may update these Terms from time to time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.

3 Eligibility

You must provide accurate information when creating an account.

Users must be legally capable of entering into transactions under applicable law.

Where a particular category or transaction has an age, licensing, registration or other legal requirement, the User is responsible for complying with that requirement.

4 User Accounts

You are responsible for:

• Keeping your login details confidential.
• Providing accurate registration information.
• Updating your information when necessary.
• All activities carried out through your account.
• Immediately informing LivingLanka if you suspect unauthorized access.

You must not:

• Create an account using another person's identity.
• Create multiple accounts for fraudulent purposes.
• Share your account with another person.
• Impersonate another individual or business.

LivingLanka may suspend or terminate accounts that violate these Terms.

5 Posting Advertisements

Users may post Listings for permitted goods, properties, vehicles, jobs and services.

All Listings must:

• Be truthful and accurate.
• Contain genuine information.
• Use appropriate photographs.
• Clearly describe the product or service.
• State the correct price or relevant pricing information.
• Identify relevant conditions or limitations.
• Comply with applicable Sri Lankan laws and regulations.

You must not deliberately provide misleading, false, exaggerated or fraudulent information.

6 Prohibited Listings

LivingLanka may prohibit or remove Listings involving illegal, dangerous, fraudulent or otherwise restricted products or services.

Examples include, but are not limited to:

• Illegal drugs and controlled substances.
• Firearms, ammunition and prohibited weapons.
• Explosives.
• Counterfeit goods.
• Stolen goods.
• Fraudulent documents.
• Fake identification documents.
• Hacking tools or malicious software.
• Illegal financial schemes.
• Pyramid or fraudulent investment schemes.
• Adult sexual services.
• Content involving exploitation or abuse.
• Illegal wildlife or protected animals.
• Any product or service prohibited by applicable law.
• Any Listing that LivingLanka reasonably considers unsafe, fraudulent or inappropriate.

LivingLanka reserves the right to remove any Listing that violates our policies or applicable law.

7 Property Listings

For property advertisements, the advertiser is responsible for ensuring that:

• The property exists.
• The advertiser has the legal right or authority to advertise it.
• Property details are accurate.
• Ownership or rental information is not misleading.
• Images accurately represent the property.

LivingLanka does not guarantee ownership, title, legal status, approvals, permits, zoning, valuation or other property-related information.

8 Vehicle Listings

Vehicle sellers are responsible for providing accurate information about:

• Make and model.
• Year.
• Mileage.
• Registration.
• Condition.
• Ownership.
• Accident history where relevant.
• Financing or leasing status where relevant.

Buyers should independently verify registration, ownership, chassis/engine numbers, service history, condition and other relevant documents before purchasing.

LivingLanka does not guarantee the authenticity, ownership or condition of any vehicle.

9 Jobs & Employment Listings

Employers are responsible for ensuring that job advertisements are genuine and lawful.

Users must not post:

• Fake employment opportunities.
• Recruitment scams.
• Requests for unlawful payments.
• Fraudulent work-from-home schemes.
• Misleading salary or employment information.
• Discriminatory or unlawful employment advertisements.

LivingLanka does not guarantee employment, salary, qualifications, employer identity or the outcome of any recruitment process.

10 Electronics & Mobiles

Sellers must accurately describe the condition of electronics and mobile devices.

Where applicable, sellers should disclose:

• New/used/refurbished status.
• Brand and model.
• Storage capacity.
• Condition.
• Warranty.
• Accessories included.
• Known defects.
• IMEI or other relevant identification information where legally appropriate.

Users should verify the product before completing a transaction.

11 Pets

Users posting pet-related Listings must comply with all applicable animal welfare, veterinary, ownership, import/export and other legal requirements.

LivingLanka does not guarantee the health, vaccination status, breed, ownership or condition of any animal advertised through the Platform.

12 Services

Service providers are responsible for accurately describing their qualifications, experience, pricing and services.

Users should independently verify licences, qualifications, registrations and references where relevant.

LivingLanka does not guarantee the quality, legality, availability or outcome of services provided by Users.

13 Transactions Between Users

LivingLanka primarily provides a platform for Users to connect.

Unless expressly stated otherwise, LivingLanka is not a party to transactions between Buyers and Sellers.

Users are responsible for:

• Negotiating prices.
• Inspecting products.
• Verifying ownership.
• Confirming payment arrangements.
• Agreeing delivery or collection arrangements.
• Entering into contracts where necessary.
• Complying with applicable laws.

Users should exercise appropriate caution and verify the identity and information of the other party.

14 Payments

Where LivingLanka provides paid advertising, premium listings, subscriptions or other paid services:

• Applicable fees will be displayed before payment.
• Users are responsible for providing accurate payment information.
• Fees may be subject to applicable taxes.
• Paid advertising does not guarantee a sale, enquiry, rental or employment outcome.

Where third-party payment providers are used, their terms and privacy policies may also apply.

15 Premium & Featured Listings

LivingLanka may offer:

• Premium Listings.
• Featured Listings.
• Sponsored Listings.
• Boosted Listings.
• Business packages.
• Subscription packages.

These services may improve visibility but do not guarantee a transaction or specific number of views, enquiries or sales.

16 Listing Approval and Removal

LivingLanka may, at its discretion:

• Review Listings.
• Reject Listings.
• Edit or request correction of Listings.
• Remove Listings.
• Restrict accounts.
• Suspend accounts.
• Terminate accounts.

We may take these actions where we believe a Listing or account:

• Violates these Terms.
• Violates applicable law.
• Is fraudulent.
• Creates a safety risk.
• Misleads Users.
• Generates complaints.
• Damages the integrity of the Platform.

17 Verified Sellers

Where LivingLanka offers a Verified Seller feature, verification means that LivingLanka has completed certain verification procedures specified by us.

Verification does not constitute a guarantee that:

• The Seller is completely risk-free.
• Every Listing is genuine.
• Products are defect-free.
• A transaction will be successful.
• The Seller will fulfil an agreement.

Users should still perform their own due diligence.

18 User Content

You retain ownership of content that you upload, subject to the rights granted to LivingLanka under these Terms.

By uploading photographs, videos, descriptions, logos or other content, you grant LivingLanka a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, format, distribute and promote that content in connection with operating and marketing the Platform.

You confirm that you have the necessary rights to upload the content.

19 Prohibited User Conduct

Users must not:

• Commit fraud.
• Misrepresent products.
• Upload stolen content.
• Harass other Users.
• Threaten other Users.
• Spam other Users.
• Manipulate Listings.
• Create fake reviews.
• Circumvent Platform restrictions.
• Use automated systems to abuse the Platform.
• Attempt to gain unauthorized access.
• Introduce malware.
• Interfere with Platform operations.
• Collect another User's information for unlawful purposes.
• Use LivingLanka for illegal activities.

20 Intellectual Property

The LivingLanka name, logo, graphics, software, website design, application design, text and other Platform materials may be protected by intellectual property laws.

Users may not copy, reproduce, modify, distribute or commercially exploit LivingLanka's intellectual property without written permission.

21 Third-Party Links and Services

The Platform may contain links to third-party websites, payment providers, maps, social networks or other services.

LivingLanka is not responsible for the content, security, availability or policies of third-party services.

Users should review the applicable third-party terms before using those services.

22 Fraud and Safety

LivingLanka may cooperate with relevant authorities where legally required or where we reasonably believe there is fraud, illegal activity or a threat to safety.

Users should report suspicious Listings, accounts or transactions to LivingLanka.

23 Disclaimer

LivingLanka operates as a marketplace/classified platform and does not generally own, manufacture, inspect, sell or provide the products and services advertised by Users.

Accordingly, LivingLanka does not guarantee:

• Accuracy of Listings.
• Product quality.
• Product authenticity.
• Seller identity.
• Buyer identity.
• Ownership.
• Availability.
• Prices.
• Condition.
• Safety.
• Delivery.
• Payment.
• Employment.
• Rental arrangements.
• Completion of transactions.

Users are responsible for conducting appropriate due diligence.

24 Limitation of Liability

To the maximum extent permitted by applicable law, LivingLanka will not be responsible for losses arising from transactions or interactions between Users, including fraud, misrepresentation, non-delivery, defective products, disputes, property transactions, employment arrangements or service agreements.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

25 Indemnification

To the extent permitted by law, you agree to indemnify and hold LivingLanka, its owners, employees, officers and service providers harmless from claims, losses, damages, liabilities and expenses arising from:

• Your Listings.
• Your use of the Platform.
• Your violation of these Terms.
• Your violation of another person's rights.
• Your violation of applicable law.

26 Suspension and Termination

LivingLanka may suspend or terminate your account if you:

• Breach these Terms.
• Engage in fraudulent activity.
• Post prohibited content.
• Abuse other Users.
• Misuse the Platform.
• Engage in illegal activities.

You may stop using the Platform at any time.

27 Complaints and Disputes

Users should first attempt to resolve transaction disputes directly with the other party.

Complaints concerning Listings or Platform services may be submitted to:

Nothing in these Terms prevents a consumer from exercising any rights available under applicable law.

28 Governing Law

These Terms shall be governed by the laws of the Democratic Socialist Republic of Sri Lanka, subject to any mandatory legal rights available to Users.

Any dispute concerning the Platform shall be subject to the jurisdiction of the appropriate courts of Sri Lanka, unless applicable law requires otherwise.

29 Changes to These Terms

LivingLanka may update these Terms when necessary.

The latest version will be made available through the Platform, together with the effective date.
